MOFCOM Announcement No. 72 of 2016 on Application of Anti-dumping and Countervailing Duty Rates to Coöperatie AVEBE U.A. under the Anti-dumping Measures against Potato Starch

On February 5, 2007, Ministry of Commerce of the People’s Republic of China (hereinafter referred to as the “Ministry of Commerce”) issued the Announcement No. 8 of 2007, deciding to impose anti-dumping duties on imports of potato starch originated in the EU. On April 18, 2011, the Ministry of Commerce issued the Announcement No. 16 of 2011, making adjustments to the anti-dumping measures against imports of potato starch originated in the EU. On February 5, 2013, the Ministry of Commerce issued the Announcement No. 4 of 2013, deciding to maintain the anti-dumping measures against imports of potato starch originated in the EU for a period of five years. At present, the anti-dumping duty rate applicable to AVEBE U.A. is 12.6%, and the rate applicable to other EU companies is 56.7%.

On September 16, 2011, the Ministry of Commerce issued the Announcement No. 54 of 2011, deciding to impose countervailing duty rate on imports of potato starch originated in the EU. On September 14, 2016, the Ministry of Commerce issued the Announcement No. 43 of 2016, deciding to conduct expiry review investigations of countervailing measures. At present, the countervailing duty rate applicable to AVEBE U.A. is 12.4%, and the rate applicable to other EU companies is 12.4%.

On October 14, 2016, Coöperatie AVEBE U.A. submitted an application to the Ministry of Commerce, claiming that, according to the requirements from the Dutch Chamber of Commerce, as a farmers' cooperative, AVEBE U.A. is required to add “Coöperatie” (Dutch word for cooperative) in its name. AVEBE U.A. ceased using its original name, requested the application of the anti-dumping duty rate and countervailing duty rate under the anti-dumping and countervailing measures against potato starch, and submitted relevant evidentiary materials such as the mails between the Dutch Chamber of Commerce and AVEBE U.A. requiring change of name, the internal announcement of the company on name change, the business license, production capacity, information concerning raw material suppliers and sales customers, and certification documents from Netherlands Government and Chinese Embassy in Netherlands.

The Ministry of Commerce notified the potato starch industry of China in regard to the matters above, and the potato starch industry of China did not raise any objections within a specified time.

On November 11, 2016, Coöperatie AVEBE U.A. supplemented the business license before the name change, the information concerning the shareholders, directors and supervisors before and after the name change, and production procedures. On November 15, 2016, Coöperatie AVEBE U.A. supplemented the information concerning the production facilities before and after the name change.

Upon review, the Ministry of Commerce believed that, existing proof shows that the name change of Coöperatie AVEBE U.A. complied with relevant laws and regulations of the country where it is located, and there were no changes in the operation and management of potato starch and the production capability and no substantial changes in the supplier relation, customer base and the management personnel before and after the name change.

Therefore, the Ministry of Commerce hereby decides that, the anti-dumping duty rate of 12.6% and countervailing duty rate of 12.4% under the anti-dumping and countervailing measures against potato starch respectively applicable to AVEBE U.A. and other rights and obligations shall apply to Coöperatie AVEBE U.A. And the anti-dumping duty rate of 56.7% and countervailing duty rate of 12.4% under the anti-dumping and countervailing measures against potato starch respectively applicable to other EU companies shall apply to exports of potato starch to China in the name of AVEBE U.A.

This Announcement will take effects as of December 15, 2016
